Terms and conditions
Please see below our T&Cs for Pilates & Physiotherapy offered by Curva Spine Ltd.
- General Overview
These Terms and Conditions (“Terms”) govern the use of our services, including Pilates classes (1-2-1, group, and on-demand) and physiotherapy sessions provided by Curva Spine Ltd (“the Company”). By engaging in our services, you (“the Client”) agree to comply with these Terms.
- Legal Jurisdiction
All services provided by the Company, whether accessed within or outside the United Kingdom, are governed by the laws of England, Scotland, Wales, and Northern Ireland. Any disputes, claims, or legal actions brought against the Company must be filed in a court within this jurisdiction.
- Limitations on Physiotherapy Services
– The Company cannot provide physiotherapy services to clients residing outside of the United Kingdom. This includes but is not limited to clients in Europe, the United States of America, Canada, and any other non-UK territories.
– Clients from these regions are prohibited from booking or participating in any form of physiotherapy session.
- Pilates Services
– Clients residing outside of the United Kingdom may participate in virtual Pilates sessions; however, any legal matters arising from these services will be handled exclusively under UK jurisdiction as outlined in Section 2.
- Health and Safety Requirements for Pilates Participation
– Medical Clearance: Before participating in any form of Pilates class (1-2-1, group, or on-demand), Clients must receive explicit clearance from a spinal consultant or an equivalent medical professional.
– Group and On-Demand Classes: These are suitable only for Clients who are at least one year post-operative. If a Client is less than one year post-op, participation in group or on-demand classes is strictly prohibited, unless with explicit sign off from a medical professional as above.
– 1-2-1 Pilates Classes (Less than One Year Post-Op): Clients who are less than one year post-operative may only participate in 1-2-1 Pilates sessions with explicit sign-off from a medical professional as above. The Company also strongly advises that such Clients undergo a physiotherapy consultation prior to commencing Pilates.
– Health Declaration: All Clients must complete a health form prior to beginning any Pilates class or physiotherapy session. The health form must be updated with any new injuries or changes in health conditions, and these changes must be communicated to the instructor or therapist before the next session.
- Client Responsibilities
– Clients acknowledge that they are responsible for their own health and well-being. It is the Client’s responsibility to determine whether they are physically fit and capable of participating in group and on-demand Pilates sessions.
– Clients must stop participating in the session if they experience pain, discomfort, or any adverse symptoms. It is advised that Clients consult with their doctor or healthcare provider if they have any concerns about their ability to participate.
– For group classes, Clients must inform the instructor of any new injuries, pain, or changes in their health condition before the start of the session.
– The Company shall not be held liable for any injuries or health issues that arise from participating in Pilates or physiotherapy sessions, particularly if the Client has not disclosed pertinent medical information or ignored medical advice.
- Insurance and Liability
– The Company maintains public liability insurance for the services provided. However, the Company does not accept liability for any claims made outside of the jurisdiction of the United Kingdom as described in Section 2.
– The Company shall not be held responsible for injuries, damages, or losses that arise as a result of a Client’s failure to adhere to the health and safety guidelines outlined in these Terms.
– The Company is not responsible for any adverse effects that may arise from participation in virtual Pilates or physiotherapy sessions if the Client has not obtained prior medical clearance as required.
- Booking, Payment, and Cancellation Policy
– The Company reserves the right to cancel or reschedule sessions due to unforeseen circumstances, in which case Clients will be notified as soon as possible.
– Group Class & On Demand
- Subscription
- Monthly subscription payments are automated via the Build & Breathe website and can be set up by adding your payment details within the members area. This can be amended here.
- Your first payment will be taken the day after your first session, and payments thereafter will be taken on the same date each month.
- If there are any amendments to subscription fees, you will be notified of these at least one month before they are applied.
- Group class subscriptions grant access to x1 weekly group class. If for any reason you are unable to attend this session, you are entitled to attend an alternate class to catch-up. Catch up sessions can be taken up to x6 weeks after the missed session. After this, you will not be able to claim the session. Catch-up sessions do not hold any monetary value and are to be taken in addition to your weekly class. You will not be able to claim a catch-up session in place of your weekly spot.
- Cancellation
- If you wish to cancel your subscription, please email info@buildbreathe.co.uk to let us know.
- We ask that you grant us one months’ notice for any cancellations. Therefore, payment will be taken for the month following you notifying us of your cancellation, and you will have access to classes during this time. Any outstanding catchups may be taken over the following 6 weeks as above.
– 1-2-1 Pilates and Physiotherapy
- Payments
- Payment for 1-2-1 Pilates and Physiotherapy is required at the time of booking unless otherwise agreed in writing.
- 1-2-1 Pilates is managed via a subscription, with payments automated via the Build & Breathe website. Subscriptions renew each month, covering the number of sessions to be completed the following month, minus any adjustments for cancelled sessions the previous month. Subscriptions can be managed here.
- If there are any amendments to fees, you will be notified of these at least one month before they are applied.
- Cancellations
- In the event you need to cancel a Physiotherapy or 1-2-1 Pilates session, please confirm this via email to organise a rearranged session. Cancellations within 24hrs of the organised session will be charged in full.
- If you are delayed in attending the session, we will wait for a short time period for you to arrive before assuming this is a cancelled session.
- For a 45 or 60 minute session, we can wait up to 15 minutes for you to arrive, at which point we will run a shorter session finishing at the original time. After 15 minutes, we will assume the class is cancelled, with a full charge as above. For a half hour-long session, this wait time is reduced to 10 minutes.
- On-Demand Services
– Access to on-demand Pilates classes is granted on a subscription basis. By purchasing on-demand content, Clients agree to the following:
– The content is for personal use only and may not be shared or distributed.
– Participation in on-demand classes should be undertaken with prior medical clearance, as stated in Section 5.
– The Company is not liable for any injuries sustained while using on-demand content, especially if the Client has not followed the advised precautions.
- Amendments to Terms and Conditions
– The Company reserves the right to update or amend these Terms at any time. Any changes will be communicated to Clients via email or through our website. Continued use of our services constitutes acceptance of the revised Terms.
